Terms and Conditions
ABOUT THE EVENT:
The Onchain Game Jam by Bario Entertainment System (the “Organizers”) is an online game development marathon focused on fostering creativity and innovation in the onchain gaming ecosystem. By participating, you (“Participant” or “Participants”) agree to be bound by these Terms and Conditions (“Terms”). For further details, please refer to the official event page.
GENERAL PROVISIONS
Organizers:
The Onchain Game Jam is hosted by Bario Entertainment System. All official communications, including announcements and updates, will be made via the official event platform and channels.
Event Duration and Format:
The Onchain Game Jam will run online from December 15, 2024, through March 15, 2025. All submissions and judging will occur via Itch.io. Participants are solely responsible for ensuring stable internet access, proper hardware, and any necessary software tools.
Eligibility:
Age Requirement: Participants must be at least 18 years old. In team submissions, at least one team member must meet this age requirement. Individuals under 18 must have verifiable written consent from a parent or legal guardian. Such consent must be provided upon request.
Legal Compliance: Participation is open worldwide except where prohibited by law, export controls, or economic sanctions. Participants must comply with all applicable laws, regulations, and international sanctions. If participation violates local or international laws, Participants are prohibited from entering, and the Organizers may disqualify such entries at their sole discretion.
Other Restrictions: Participants must ensure that entering the Game Jam does not violate any employment agreements, school policies, or other contractual obligations they may have.
Valid Project Requirements:
To qualify, submitted projects (“Valid Projects”) must:
Comply with these Terms.
Be developed entirely during the Game Jam period without using previously completed games or substantial portions thereof.
Run in a web browser, be mobile-compatible, and not exceed 250MB in size.
Be suitable for players aged 12+ and free from offensive, harmful, or illegal content.
Be submitted before the stated deadline and include all required information (e.g., team name, contact details, description, instructions).
TERMS AND RULES OF PARTICIPATION
Respectful Conduct:
Participants agree to maintain a respectful and inclusive environment. Harassment, discrimination, hate speech, and other inappropriate behaviors will result in immediate disqualification at the Organizers’ sole discretion.
Registration & Representation:
Registration is free. For team entries, a designated representative will communicate with the Organizers. The Organizers will direct official communications to this representative, and the representative is responsible for relaying such communications to their team.
Team Formation:
Teams may be of any size. Individuals may also participate on their own. Teams are responsible for managing their internal roles, contributions, and distribution of any prizes.
Use of Assets and External Resources:
Participants may use pre-existing assets (e.g., art, music, code snippets) provided they have the necessary rights, licenses, or permissions.
The use of illegally obtained, unlicensed, or infringing materials is strictly prohibited and will result in disqualification.
Open-source code or publicly available assets may be used according to their respective licenses. Proper attribution must be provided where required.
Technical Requirements:
Submitted games must be playable in a standard web browser environment without requiring proprietary plugins.
Projects should prioritize device compatibility and accessibility.
Originality and Exclusivity:
Games must be created during the official event period. While Participants can prepare concepts, design documents, or basic sketches beforehand, no significant development (coding, asset creation beyond placeholders) should occur prior to the start date.
Prohibited Content:
Submissions must not contain any harmful code (viruses, malware, spyware), hate speech, inflammatory content, libelous or scandalous statements, vulgar, obscene, or discriminatory materials, or content that infringes upon the rights of any third party.
Submission Deadline:
All entries must be submitted by 11:59 PM UTC on March 15, 2025. Late submissions will not be considered, regardless of technical or personal issues.
Fair Play and Integrity:
Any form of cheating, tampering with submissions, or attempting to undermine the judging process is prohibited and may result in disqualification.
SELECTION OF FINALISTS / AWARDS
Prize Pool:
A total of 3 ETH will be awarded:
1st Place: 1.5 ETH
2nd Place: 1 ETH
3rd Place: 0.5 ETH
Additional rewards (0.01 to 0.05 ETH) may be provided for all eligible submissions meeting these Terms.
Judging Criteria and Process:
The judging criteria (e.g., innovation, gameplay, art, audio, onchain functionality) will be outlined in the Game Jam guide. Judging is at the sole discretion of the Organizers and the appointed judges. All decisions are final and binding.
Announcement of Winners:
Winners will be announced on the event’s official platforms after the judging period concludes. The Organizers will endeavor to notify winners promptly, but are not liable for any communication delays or issues.
Prize Distribution:
Prizes will be distributed via Ethereum wallets on the Base network. Participants are responsible for providing accurate wallet information. The Organizers are not liable for any loss of prizes due to incorrect wallet addresses, participant inaccessibility, or technical issues beyond their control.
Claiming Prizes:
Winners must claim their prizes within 30 days of the announcement. Failure to claim may result in forfeiture of the prize.
Disqualification and Forfeiture:
The Organizers reserve the right to disqualify any Participant or revoke awards in the event of non-compliance with these Terms, evidence of misconduct, or violation of laws or regulations.
INTELLECTUAL PROPERTY AND CONTENT USAGE
Ownership Rights:
Participants retain full ownership of their submitted projects and intellectual property.
Promotional Use:
By participating, Participants grant the Organizers a non-exclusive, worldwide, royalty-free license to use submitted materials (including screenshots, videos, and descriptions) for promotional and marketing purposes related to the Game Jam or similar future events, without additional compensation.
Originality and Third-Party Rights:
Participants represent and warrant that their submissions are original and do not infringe upon any third-party rights, including copyrights, trademarks, or other intellectual property rights.
INDEMNIFICATION AND LIABILITY
Indemnification:
Participants agree to defend, indemnify, and hold harmless the Organizers and their affiliates, sponsors, partners, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to their participation in the Game Jam, their submissions, or any breach of these Terms.
Limitation of Liability:
Under no circumstances will the Organizers be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from the Game Jam, participation therein, or use of any submitted project. This includes but is not limited to lost profits, revenue, data, or other economic advantage, even if advised of the possibility of such damages.
Sanctions Compliance:
Participants must comply with all applicable export control and economic sanctions laws and regulations. The Organizers reserve the right to disqualify any Participant who violates such laws or whose participation would cause sanctions-related risk for the Organizers.
PRIVACY AND DATA PROCESSING
Personal Data:
Participants consent to the collection and processing of their personal data (e.g., name, email, wallet address) for the purpose of organizing and executing the Game Jam, including prize distribution.
Data Protection:
The Organizers will implement reasonable measures to safeguard personal data. However, the Organizers are not liable for breaches caused by third-party platforms or circumstances beyond their control.
EVENT MODIFICATION AND FORCE MAJEURE
Right to Modify or Cancel:
The Organizers reserve the right to modify, suspend, or cancel the Game Jam in whole or in part due to unforeseen circumstances, technical issues, legal requirements, or force majeure events (e.g., natural disasters, strikes, widespread internet outages).
Notice of Changes:
Should changes be necessary, the Organizers will endeavor to inform Participants promptly. Continued participation after any modifications constitutes acceptance of the revised Terms.
ACCEPTANCE AND GOVERNING LAW
Acceptance of Terms:
Participation in the Game Jam constitutes acceptance of these Terms in their entirety.
Governing Law and Jurisdiction:
These Terms are governed by the laws of the Netherlands. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts in the Netherlands.
